  24. Hot Door, Inc. ("Hot Door") Transparency End User License Agreement
  25. for Mac OS
  26. permitted number of computers: 1
  27.  
  28. By installing this software, you accept all the terms and conditions of
  29. this Agreement. If you do not agree to these terms, delete the enclosed
  30. software. This enclosure contains Software and Documentation. Hot Door
  31. grants you a nonexclusive license to use the Software and Documentation,
  32. provided you agree to the following:

  34. 1. Grant of License: Hot Door grants to you the right to install the 
  35. Software in a single location on a storage device of up to the permitted 
  36. number of computers indicated above. If the Software is intended for 
  37. network use, Hot Door grants you the right to install and use the 
  38. Software on a single file server for use on a single local area network 
  39. for either 1) permanent installation on a storage device of up to the 
  40. permitted number of computers OR 2) use of the Software over this network 
  41. if the number of computers on which the Software is used does not exceed 
  42. the permitted number of computers.

  44. 2. Prohibited Uses: The software is owned by Hot Door or its suppliers
  45. and is protected by United States copyright laws and the international
  46. treaty provisions. You must agree to treat the Software like any other
  47. copyrighted material, such as a book or recording, with the exception
  48. that you may make one backup copy of the Software, provided that your
  49. backup copy is not installed or used on any computer. This copy must
  50. contain the same copyright and other proprietary notices that appear on
  51. or in the Software. You agree not to reverse engineer, decompile,
  52. disassemble, create derivative works, or otherwise attempt to discover
  53. the source code of the Software. You may not sell, rent, sublicense or
  54. lease the Software or Documentation. However, you may transfer the
  55. Software and accompanying written materials on a permanent basis
  56. provided that you retain no copies and that the recipient agrees to the
  57. terms of this Agreement. You agree that the Software is subject to
  58. restrictions and controls imposed by the United States Export
  59. Administration Act and regulations thereunder. You agree and certify
  60. that neither the Software nor any direct product thereof is being or
  61. will be acquired, shipped, transferred or re-exported, directly or
  62. indirectly, into any country prohibited by the Act and the regulations
  63. thereunder.

  65. 3. Limited Warranty & Liability: Hot Door warrants that, upon delivery
  66. by Hot Door, the media on which the Software program is distributed will
  67. be free from defects in materials and the Software will perform in
  68. accordance with the Documentation by Hot Door.  To make a warranty
  69. claim, return the Software to the place of purchase along with a copy of
  70. your paid invoice within 90 days of the date you received the software
  71. or within the period stated by the return policy of the supplier,
  72. whichever is sooner. If the Software fails to comply with the warranties
  73. set forth above, Hot Door will replace the media or refund the license
  74. fee you paid for the software.  HOT DOOR DOES NOT AND CANNOT WARRANT
  75. THAT THE SOFTWARE IS FREE FROM ALL BUGS, ERRORS AND OMISSIONS.  HOT DOOR
  76. MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING WARRANTIES OF
  77. MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  THE ENTIRE RISK
  78. AS TO THE RESULTS AND PERFORMANCE OF THE SOFTWARE IS ASSUMED BY YOU.

  80. HOT DOOR OR ITS SUPPLIERS WILL IN NO EVENT BE LIABLE TO YOU FOR ANY
  81. CONSEQUENTIAL OR INDIRECT DAMAGES, INCLUDING ANY LOST DATA, LOST
  82. PROFITS, OR LOST SAVINGS, ARISING OUT OF THE USE OR INABILITY TO USE THE
  83. SOFTWARE, EVEN IF A HOT DOOR REPRESENTATIVE HAS BEEN ADVISED OF THE
  84. POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY.

  86. Because some jurisdictions do not allow the exclusion or limitation of
  87. liability for consequential or incidental damages, the above exclusions
  88. may not apply to you.

  90. 4. Government Licensee: Hot Door Software and Documentation are provided
  91. with RESTRICTED RIGHTS. Use, disclosure and duplication are subject to
  92. Federal Acquisition Regulations, 52.227-7013 (c) (1) (ii).

  94. 5.  General: This agreement shall be governed by the laws of the State
  95. of California excluding the application of its conflicts of law rules.
